Garvey “Defense” to FTC Lawsuit: I Never Questioned What I was Told
On October 10, the Garvey consultants sent out an email explaining why their client was the right candidate for Senate. One reason was that he was the “face” of several national brands—of course not mentioning the fact that he was paid to be the face. But one brand he did not mention was marketing of a weight loss system sold by Enforma Natural Products, Inc.
Could that be because the FTC sued him for fraud in the selling of the weight loss potion?
The bottom line: He took the word of a firm, without question, that was fined $10 million (a lot 20 years ago) for misleading the public.
In other words, he did not do any independent research on the product (he and his wife took the pills for a short period of time), questioned what was given him, Steve Garvey took the money, closed his eyes and ears and told people to buy a product that per his statements would lose weight—but there was no data to prove that. That is why the FTC fined the company $10 million.
As a Senator, we still do not know what he believes—refuses to give public speeches, hides behinds PR people and consultants, and has not told us how HE would vote on key issues like China, drugs, 2nd Amendment, Israel, etc.
The worst part is that this was sent to me by a Democrat consultant—both Schiff and Porter have this information. If Garvey does get into the Top Two, our candidates will have to either defend Garvey or cut him loose. Either way, Garvey on the November ballot will harm our candidates.
FEDERAL TRADE COMMISSION v. GARVEY (2004)
Look how Garvey “won” the case: “The district court held a three-day bench trial on the FTC’s claims against the Garvey defendants. On November 25, 2002, the district court issued its findings of fact and conclusions of law and entered judgment in favor of the Garvey defendants. The court concluded that Garvey could not be held liable under a “participant” theory of liability. The court found that Garvey did not have actual knowledge of any material misrepresentations, that he was not recklessly indifferent to the truth or falsity of any representations he made, and that he was neither aware of a high probability that he was making fraudulent representations nor intentionally avoiding the truth with respect to the qualities of the Enforma System. Cf. FTC v. Publ’g Clearing House, Inc., 104 F.3d 1168, 1171 (9th Cir.1997). The district court also found that Garvey could not be held liable as an “endorser” because there was no evidence showing that his statements did not reflect his good faith belief and opinions and there was reasonable substantiation for the statements he made.”
Will Garvey as Senator parrot what he is told, like he did in the weight loss pills case, or think for himself? Up to now we are not even sure he knows he is running for Senate—but the Democrats would love to have him in the Top Two—saying Garvey represents the GOP and here is his background. Our financial and national security is at stake in the Senate. A “good faith belief” is not enough when families and lives are at stake.
Since Steve Garvey has no political or public policy background—or views—maybe he should have taken the words of President Ronald Reagan, “Trust but verify”.
