Assemblyman Carl DeMaio:  Newsom Needs to Stop Abusing His Office and Your $$$

Glad to see an aggressive effort to stop the abuse of Newsom and his Sacramento by a Republican elected official.  On the day before he was sworn in as a member of the Assembly, Carl DeMaio showed he is a leader and willing to be aggressive on behalf of the people of California.

“Given that the Special Session called by the Governor is about protecting the rights of Californians, DeMaio has found a clever way to turn the tables on Newsom and the Democrat Super-Majority that controls the state legislature.

As soon as the Special Session is called to order, DeMaio will introduce the “Punish Unconstitutional Actions Act of 2025” — a measure that will impose stiff penalties on the Governor and other state leaders when they are found to have violated the constitutional rights of citizens.

Specifically, the law would penalize any Governor who signs and any legislator who votes for a law that is later found to be unconstitutional in federal courts with a 25% cut in their annual state compensation — for each offense.”

There has to be consequences for elected officials who abuse our taxes and their authority.  I expect DeMaio is not going to be a back bencher or someone that works quietly behind the scenes (in other words, does not work).

As you may have heard, tomorrow Gov. Gavin Newsom is convening an “emergency” meeting of the CA State Legislature to “Trump Proof” California to “protect citizens’ rights.”  But given the Governor’s pattern of violating the constitution, I’m planning to turn the tables on the Governor by introducing this bill to “Newsom-Proof” California.

  “Given how many times he has abused his power and been found by federal courts to have infringed on our constitutional rights, it is clear that Californians need protection from Gavin Newsom — not Donald Trump.” – Carl DeMaio   Moments after the California State Legislature convenes today, members will be forced by Gov. Gavin Newsom into a Special Session to authorize litigation and authorize other actions to “defend Californians’ rights from attack by Donald Trump.”

Newly-elected State Assemblyman Carl DeMaio says the session should actually be used to “defend Californians’ rights from Gavin Newsom.” “It is utterly hypocritical for Gavin Newsom to say he wants to protect the rights of Californians from attack – when this is the same guy who has a terrible record of abusing power and imposing laws and regulations that federal courts have repeatedly ruled to be unlawful and unconstitutional,” DeMaio says.

Specifically, the law would penalize any Governor who signs and any legislator who votes for a law that is later found to be unconstitutional in federal courts with a 25% cut in their annual state compensation — for each offense. “Once this law takes effect, Newsom and California legislators better clean up their act quick because with their poor record of being overturned by federal courts for violating our rights, they soon will be working for free,” DeMaio quips.

DeMaio says the measure is needed because California politicians face no consequences currently for repeatedly imposing laws and orders that are blatantly unconstitutional — depriving citizens of their rights and forcing them to bear the upfront legal costs to regain them. In recent years, California state laws and regulations have increasingly been overturned by the US Supreme Court and lower federal courts as being unconstitutional – including laws relating to 1st Amendment rights of free speech and free exercise of religion, 2nd Amendment rights of self-defense, 5th Amendment rights of property rights and due process, and 14th Amendment rights of equal protection.

In the final few weeks leading up to the 2024 election, Governor Newsom signed legislation that would bring penalties against individuals for election-related speech on social media — a move criticized by many as election interference and immediately ruled unconstitutional by a federal judge.

“Penalizing the Governor and individual legislators when they violate constitutional rights would serve as not only a deterrence but a punishment for harm done to citizens and damage done to our democratic system,” DeMaio says. “The real threat to democracy and civil rights is Gavin Newsom’s political ambition, his repeated intentional violation of citizens’ constitutional rights, and gross negligence in failing to address real problems facing Californians,” DeMaio concludes.
