It looks like the McCarthy resignation from Congress has set off a stream of bad news for the Republican Party.

  1.  By resigning after December 13, he gives Gov. Newsom the right NOT to call a special election to replacement.  That means for one year, the seat will be vacant, and the small majority in Congress is further reduced.
  2. Even if a Special Election is called, that election would be on March 5, with a runoff in May or June—for six months the House GOP will lose a vote that is much needed.
  3. Prior to 5:00pm on December 8, Assemblyman Vince Fong filed to run for re-election.  On the form it is noted that once you file, you can not withdraw.  And, filing has closed.  If a Democrat filed against him, and no other Republican—the Democrats will gain yet another GOP Assembly seat.
  4. Now her wants to file for the full congressional term, which starts in January, 2025.  Under California law, he can not run for two offices.  Even if the Secretary of State and the Registrar of voters allows him to either withdraw or run for two seats at the same time, expect lawsuits.

Fong, in a statement: “It is my strong belief that the Central Valley must continue to be represented by proven, conservative leaders in Congress. In light of recent developments and in an attempt to unite our community in this critical moment in our nation’s history, I have decided to run for Congress in 2024.”
But he may have to win a legal battle: He already filed to seek reelection to the Assembly and it won’t be easy to remove his name from the ballot. You can’t run for two offices simultaneously.

CA-20: After initially saying he would not run, State Rep. Vince Fong (R) reversed course and said he would seek Rep. Kevin McCarthy’s (R) open seat. Fong is the first Republican into the race and is likely to be a front-runner. However, it’s not entirely clear Fong can get a mulligan on his prior decision to bow out; Fong has already filed to run for re-election – and may not be able to get off the ballot since filing has closed for his legislative seat. Fong would still be free and clear to run in the special election to finish McCarthy’s term but would be an instant lame-duck if he was precluded from running for a full term in the 119th Congress.
