HEARD ON THE TOM/TOMS

Heard on the Tom/Toms

  1. As we know, someone in the Kern County Central Committee, without a vote or notification of the members, authorized a $50,000 check to go to a Las Vegas PAC, to support candidates for Congress, Assembly and the Central Committee.  It appears that some of the people involved are also on the slate of candidates supported by this expenditure.  At the least, that makes it a conflict of interest.  To some, it looks like embezzlement.

Since this has been made public, three complaints have been filed with the FPPC about this.

In the past, big money was embezzled by a Treasurer—yet he never went to jail.  Will the Machine be able to stop a criminal investigation?

Now I am told attorneys are looking at this.  The purpose is to determine if criminal charges should be made—and to whom?  Since the Kern County Judicial system is filled with Judges endorsed by the Kern County Central Committee, the charges might be brought to the Attorney General Rob Bonta.  That would be really bad for the Machine—since Bonta is a Democrat, running for Governor.

  •  We also know that Vince Fong is being allowed to run for both Assembly and Congress at the same time.  Though on appeal, that decision will not be made till before April 10, the day the Secretary of State has to certify the elections.  SOS Webber is allowing Fong on the ballot twice—the first person in the history of California.  But, that helps the Machine.

Now, we have another candidate wanting the same rights as Fong—but here the Secretary of state is defending the Machine.  The candidate is TJ Esposito.  He, like Fong, wants to run for Congress and Assembly at the same time.  But SOS Webber has openly declared a double standard—one for the Machine, the other for the rest of us.

Here, in his own words is the TJ Esposito story, from an email he sent a friend—and then gave me permission to publish:

“Mark I paid around $2,000 dollars to sign up as a candidate for congressional district 20. It became very clear Sheriff Mike was the best man for the job, so I made a decision to suspend my campaign for congress and sign up as a write in for AD 32 (much like Vince Fong) I would be qualified for both races.

After collecting signatures and being sworn in as a candidate by Kern County elections, the SoS denied me as a candidate with 7 days before election. They told me the only way I would qualify is if I sue in court.

After learning this I discussed my options with my attorney and he said it would be $20-$30,000 for this type of case. Furthermore he advised me if I did proceed I would be playing “Russian Roulette” with my money and with peoples votes because there is a chance the case will be overturned making those votes no good.

The SoS did confirm those folks who have already written me in from the initial news announcement of me being a write in (which are in the hundreds) are not going to count.

I will not gamble with peoples vote and paying $20-$30,000 to sign up for office is totally unreasonable. Fong has no problem paying this because he is using donor funds and he has no problem gambling with peoples votes because he wins no matter what..”
